1. VOLUNTARY PARTICIPATION The Participant confirms that their participation in any trip, event, excursion, or experience organised, promoted, or facilitated by House of Sinha Community (the "Company") is entirely voluntary. The Participant has chosen to take part of their own free will and has had the opportunity to ask questions about the nature of the trip or event before booking.
2. ASSUMPTION OF RISK The Participant acknowledges that travel, group trips, and social events of this kind carry inherent risks, including but not limited to travel delays, accidents, adverse weather, illness, injury, and risks associated with transport, accommodation, venues, and activities organised by third parties. The Participant voluntarily assumes all such risks.
3. RELEASE AND WAIVER OF LIABILITY To the fullest extent permitted by law, the Participant releases and discharges the Company, its directors, trip leaders, staff, and partners from any and all liability for injury, illness, loss, or damage arising from participation in a trip or event, except where such injury, illness, loss, or damage is caused by the proven negligence of the Company.
4. MEDICAL FITNESS & DISCLOSURE The Participant confirms that they are medically fit to take part and agrees to disclose to the Company, in advance, any medical condition, allergy, or disability that may affect their participation or that the Company or its trip leaders should reasonably be aware of. The Company is not responsible for complications arising from undisclosed medical conditions.
5. EMERGENCY CONTACT & MEDICAL TREATMENT The Participant confirms that the emergency contact details provided are accurate and up to date. Where the Participant is unable to make decisions about their own medical care during a trip or event, the Participant authorises the Company's trip leaders or staff to seek emergency medical treatment on their behalf.
6. CODE OF CONDUCT The Participant agrees to behave responsibly and respectfully towards other participants, trip leaders, staff, and members of the public throughout the trip or event. The Company reserves the right to remove any Participant from a trip or event, without refund, if their conduct is deemed to endanger themselves, other participants, or the reputation of the Company.
7. PHOTOGRAPHY, VIDEO & PROMOTIONAL CONSENT The Participant consents to being photographed and filmed during the trip or event and agrees that such photographs and footage may be used by the Company for promotional purposes, including on its website and social media channels, without further compensation or consent.
8. PERSONAL BELONGINGS & TRAVEL INSURANCE The Company is not responsible for the loss, theft, or damage of personal belongings during a trip or event. The Participant is strongly encouraged to arrange their own travel or personal insurance where appropriate.
9. INDEMNIFICATION The Participant agrees to indemnify and hold harmless the Company against any claims, costs, or liabilities arising from the Participant's own negligence, misconduct, or breach of this Agreement.
10. GOVERNING LAW & ENTIRE AGREEMENT This Agreement constitutes the entire understanding between the Participant and the Company in relation to the trip or event and supersedes any prior representations. This Agreement is governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction over any dispute arising from it.
11. CANCELLATION & NO-REFUND POLICY All payments made for a trip, event, excursion, or experience organised, promoted, or facilitated by the Company are strictly non-refundable. Once a booking is confirmed and payment received, the Participant will not be entitled to any refund, in full or in part, under any circumstances, including but not limited to a change of mind, personal, family, or work commitments, illness or injury, visa or travel-document issues, denied boarding, missed flights or transport, failure to meet itinerary timings, no-show, or removal from the trip due to breach of this Agreement or the Company's reasonable conduct expectations. The Company is under no obligation to offer a refund, credit, rescheduling, or transfer of the booking to another person, though it may elect to do so entirely at its own discretion and on terms it determines. The Participant acknowledges that the Company commits funds in advance to venues, transport operators, accommodation, and third-party providers, and that this no-refund policy reflects the Company's inability to recover those committed costs following cancellation. Nothing in this clause excludes any statutory rights of the Participant that cannot be excluded under the laws of England and Wales.
